Please read these Terms of Service ("Terms") carefully before using GetScamSavvy. By creating an account, enrolling yourself or a family member, or using any part of the GetScamSavvy service, you agree to be bound by these Terms. If you do not agree, do not use the service.
GetScamSavvy is operated by TriPraxis LLC, a Virginia limited liability company ("Company," "we," "us," or "our"). Our registered address is 8401 Mayland Dr, Suite A, Richmond, VA 23294.
1. The Service
GetScamSavvy is a scam-awareness training subscription service. The service delivers simulated phishing emails and smishing (SMS text) messages to enrolled participants ("Participants"), designed to educate them on how to identify and avoid real-world scam attempts. Participants who interact with a simulated message receive immediate, in-context educational feedback. The service also includes supplemental educational materials.
The service is sold to adult subscribers ("Account Holders") who enroll themselves and/or a family member or other individual (a "Designated Participant") with that person's explicit consent, as described in Section 3 below.
2. Eligibility
To create an account, you must be at least 18 years of age and legally capable of entering into a binding contract. By using the service, you represent and warrant that you meet these requirements.
3. Consent and Enrollment of Designated Participants
3.1 Dual Consent Requirement
GetScamSavvy requires affirmative consent from both the Account Holder and any Designated Participant before simulated messages will be sent to the Designated Participant. Specifically:
- During account creation, the Account Holder must affirmatively consent on behalf of themselves and, where applicable, provide the Designated Participant's contact information and acknowledge that they have a good-faith basis to enroll that person.
- A consent notice is then sent directly to the Designated Participant at the email address and/or mobile number provided, with a copy to the Account Holder. Simulated training messages will not be sent to the Designated Participant until that person has completed their consent step.
3.2 Account Holder Representations Regarding Designated Participants
By enrolling a Designated Participant, the Account Holder represents and warrants that:
- They have a bona fide familial, caregiving, or other close personal relationship with the Designated Participant;
- They are not enrolling the Designated Participant for any deceptive, harmful, or unauthorized purpose; and
- All contact information provided for the Designated Participant is accurate.
4. Nature of Simulated Messages — Not Spam
GetScamSavvy sends simulated phishing emails and smishing text messages as part of the training service. These messages are intentionally designed to resemble real scam communications for educational purposes.
By completing enrollment — including the consent steps described in Section 3 — both the Account Holder and any Designated Participant expressly consent to receive these simulated training messages. These messages are a core, expected component of the service that you or your Designated Participant have knowingly agreed to receive. They are not unsolicited commercial messages and do not constitute spam under the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), or any applicable state law.
Every simulated message includes, or is followed by, a clear identification of its training purpose and an opportunity to unsubscribe. Account Holders and Designated Participants may opt out of simulated messages at any time as described in Section 5 below.
5. Unsubscribe and Cancellation
You may opt out of receiving simulated training messages at any time by:
- Clicking the unsubscribe link included in or accompanying each simulated email;
- Replying STOP to any simulated SMS message; or
- Contacting us at contact@getscamsavvy.com.
Opting out of simulated messages will result in cancellation of the active training program. No refunds will be issued for unused portions of a subscription term. See Section 7 for our full refund policy.
6. Subscription, Billing, and Pricing
6.1 Introductory Program
The introductory GetScamSavvy program is offered for a one-time payment of $29.00 for a six (6) week training period (the "Intro Program").
6.2 Ongoing Subscription
Following the Intro Program, GetScamSavvy will offer an ongoing monthly subscription at a rate of $10.00 per month (the "Monthly Subscription"). We will notify you in advance of any transition from the Intro Program to the Monthly Subscription. You will not be automatically enrolled in the Monthly Subscription without your affirmative consent.
6.3 Price Changes
We reserve the right to change subscription pricing at any time upon reasonable advance notice to you. Continued use of the service after a price change takes effect constitutes your acceptance of the new pricing.
7. No Refund Policy
All payments are final and non-refundable.
We do not offer refunds for the Intro Program, any Monthly Subscription period, or any unused portion of a subscription term, for any reason, including but not limited to cancellation, dissatisfaction with results, or failure to use the service.
Nothing in this Section limits any rights you may have under applicable consumer protection laws that cannot be waived by contract.
8. Disclaimer of Warranties — No Guarantee of Results
The service is provided "as is" and "as available" without warranty of any kind, express or implied.
We make no representations or warranties that:
- The service will make any Participant immune to, or incapable of falling victim to, actual scams, phishing attempts, or smishing attacks;
- Participation in the service will result in any specific improvement in a Participant's ability to identify scams;
- The service will prevent any financial loss, identity theft, fraud, or other harm resulting from a scam; or
- The simulated messages will reflect or keep pace with all current or future scam tactics.
Scammers continuously evolve their techniques. The goal of GetScamSavvy is to improve scam awareness and reduce vulnerability over time, but we cannot and do not guarantee that any Participant will not fall prey to a real scam at any point in time, during or after participation in the service. Results will vary by individual.
To the fullest extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall TriPraxis LLC, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of funds, identity theft, financial fraud, or emotional distress, arising out of or related to your use of the service or any Participant's interaction with any simulated or real scam message.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid us in the three (3) months preceding the claim.
10. User Conduct and Prohibited Uses
You agree not to use the service to:
- Enroll any person without their knowledge or without following the consent procedures in Section 3;
- Enroll any person who is a minor (under 18 years of age);
- Harass, deceive, or harm any individual;
- Circumvent or interfere with any consent or opt-out mechanism; or
- Use the service for any unlawful purpose or in violation of any applicable law or regulation.
11. Intellectual Property
All content, materials, and software comprising the GetScamSavvy service, including simulated messages, educational content, and the website, are the property of TriPraxis LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our express written permission.
12. Privacy
Our collection and use of personal information in connection with the service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the service, you consent to our data practices as described in the Privacy Policy.
13. Modifications to the Service and These Terms
We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. We also reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by email or by posting a notice on our website. Your continued use of the service after any modification constitutes your acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in the Commonwealth of Virginia, and you hereby consent to personal jurisdiction in such courts.
15. Indemnification
You agree to indemnify, defend, and hold harmless TriPraxis LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your enrollment of any Designated Participant; (c) your violation of these Terms; or (d) your violation of any applicable law.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TriPraxis LLC with respect to the service and supersede all prior or contemporaneous agreements, representations, and understandings.
